1. Who are we? VELO is an AI-powered platform that enables users to create, automate, and enhance digital solutions. We are responsible for handling your personal data and are committed to protecting your privacy in accordance with applicable laws, including international regulations such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). VELO is operated by INNOVACIÓN DE SOFTWARE INNOVASOFT S.A., a legally incorporated company in Costa Rica, legal ID 3-101-254923, located in San Pedro Montes de Oca, 150 meters west of the Rotonda de la Bandera, Oficentro Ofiplaza del Este, Building B, first floor, Office No. 4, Costa Rica. Information you provide • Name, email address, company, country. • Submitted content, prompts, or entries used with the AI. • Payment information (processed exclusively by PCI-DSS certified providers such as Stripe. VELO does not directly store card data). b. Information collected automatically • IP address, browser, device, time zone. • Site behavior, interactions, usage duration. c. AI-generated data • Results, usage patterns, metadata derived from system use. • AI-generated data belongs solely to the user unless stated otherwise with explicit consent. d. Sensitive information and third-party cookies • VELO does not collect sensitive data (such as ethnic origin, religion, health, sexual orientation, or political opinions), unless provided voluntarily with documented explicit consent. • The site uses third-party cookies (Google Analytics, Meta Pixel, etc.), manageable via our cookie banner or privacy settings section. You may opt out without affecting essential functionality. 3. How long do we retain your data? • Account data: while the account is active and up to 2 years after closure, exclusively for legal or contractual purposes. • Usage data: up to 24 months. • Generated content: can be deleted by the user or after 30 days of inactivity. 8. TERMS AND CONDITIONS OF USE
1. Acceptance By accessing and using https://www.velocreate.com/ (hereinafter, "the Platform"), you expressly accept these Terms and Conditions. If you do not agree, please refrain from using the Platform. Use is limited to adults or minors with explicit authorization from a legal guardian. 2. Registration and Account Security • You must provide truthful, current, and complete information. • You are responsible for maintaining the confidentiality and use of your credentials. • Improper or shared use of credentials is your sole responsibility. 3. Permitted Use The Platform may not be used to: • Engage in illegal, fraudulent, or unauthorized activities. • Create or distribute defamatory, misleading, discriminatory, or infringing content. • Spread malicious code, perform scraping, or breach system security without express authorization. • Train external AI models using results generated by Velo without written consent. • Reverse engineer or decompile any part of the Platform. • Use in high-risk applications (health, justice, critical infrastructure) without prior written approval. Violations may result in immediate suspension of service. 4. User-Generated Content • You retain ownership of the content you create. • You grant Velo a limited, non-exclusive, worldwide, royalty-free license to use such content solely to provide the service. • You may delete your content at any time from your account. 5. Intellectual Property All rights to the software, algorithms, brand, interface, and platform elements are the exclusive property of Velo (INNOVASOFT S.A.). Nothing herein shall be construed as a transfer of rights. 6. Third-Party Integrations You are solely responsible for the use of external tools integrated with the Platform. Velo assumes no liability for failures, data leaks, or consequences arising from third-party tools. 7. Service Changes We reserve the right to modify or temporarily suspend Platform features without notice when necessary for security, improvements, or legal compliance. Substantial changes will be communicated through usual channels. 8. Limitation of Liability • The service is provided "as is" and "as available." • We do not guarantee uninterrupted availability or error-free operation. • We are not liable for indirect, incidental, or consequential damages resulting from the use of the service. • Our total liability is limited to the amount paid by the user in the last three (3) months. • Velo is not responsible for decisions made by users based on AI-generated responses. 9. Account Cancellation You may close your account at any time. Velo reserves the right to cancel accounts that violate these terms. Associated data may be retained for up to 12 months for legal purposes, in accordance with the Privacy Policy. 10. Governing Law and Dispute Resolution This agreement is governed by the laws of the Republic of Costa Rica. In case of dispute, a direct reconciliation will be sought within 30 days. If unsuccessful, the parties will submit to confidential arbitration. If arbitration is not possible, disputes shall be submitted to the courts of San José. 11. Changes to the Terms Velo may update these Terms and Conditions. Changes will be notified by email or within the Platform, and a record of accepted versions will be maintained. 12. Indemnification You agree to indemnify and hold Velo harmless from any claim, damage, or loss arising from misuse of the Platform, violation of these Terms, or infringement of third-party rights through use of the service.
